These Terms and Conditions set out the basis on which Waste Disposal Bromley provides waste collection and related services. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
In these Terms and Conditions, unless the context requires otherwise:
Customer means the person, firm, or company requesting waste collection or disposal services from Waste Disposal Bromley.
Services means any waste collection, waste removal, bulky waste clearance, recycling, house or office clearance, and other related services provided by Waste Disposal Bromley.
Waste means any materials, items, rubbish, refuse, junk, or other matter presented to us for collection and disposal, excluding any prohibited items as detailed in these Terms and Conditions.
Contract means the agreement between the Customer and Waste Disposal Bromley comprising these Terms and Conditions and any confirmed booking details.
We, us, and our mean Waste Disposal Bromley.
You and your mean the Customer.
We provide waste collection and disposal services for domestic and commercial customers within our designated service area, which includes Bromley and surrounding locations. The exact nature of the Services for each booking will be confirmed at the time of booking based on the information you provide about the type and volume of waste.
We reserve the right to refuse or suspend Services where the waste presented does not match the description provided at the time of booking, where it includes prohibited items, or where we consider the collection location to be unsafe or inaccessible.
You may request a booking by contacting us via telephone, email, or contact form. When making a booking, you must provide accurate and complete information about:
1. The collection address, including any access restrictions.
2. The type of premises, such as residential, office, or commercial property.
3. The type and approximate quantity or volume of waste to be collected.
4. Any hazardous, heavy, or bulky items requiring special handling.
5. Your preferred collection date and time window.
We will provide you with a quote based on the information you supply. The quote may be indicative or fixed, depending on the nature of the job. The Contract between you and us is formed when we confirm your booking in writing, which may include confirmation by email or text message.
We may require additional information or photographs of the waste to provide an accurate estimate. If, on arrival, the quantity or nature of the waste differs materially from your description, we may adjust the price or decline to proceed with part or all of the Services.
You are responsible for ensuring that we have safe and reasonable access to the collection point at the agreed time. This includes arranging for parking where required, ensuring gates are unlocked, and removing obstacles that prevent safe loading of waste.
You must ensure that the waste to be collected is clearly separated from any items that are not to be removed. We are not responsible for removal of items that have not been clearly identified as waste, and we do not accept liability for any items taken in error where there has been ambiguity.
You agree to comply with all applicable laws and regulations in relation to the waste you present for collection and confirm that you have the right to authorise its removal.
We collect most common household and commercial waste, including general rubbish, furniture, non-hazardous construction debris, and recyclable materials. Some items, such as electrical equipment, mattresses, or rubble, may incur additional charges due to disposal costs and handling requirements.
The following items are generally prohibited and will not be collected unless specifically agreed in writing and subject to any additional charges and regulations:
1. Hazardous waste, including chemicals, solvents, oils, asbestos, and clinical waste.
2. Gas cylinders and pressurised containers.
3. Explosives, ammunition, or firearms.
4. Biological or medical waste.
5. Liquids not safely contained or identified.
6. Any waste classified as hazardous under applicable UK or local legislation, unless we are specifically licensed and equipped to handle it.
We reserve the right to refuse to handle any waste that we reasonably believe poses a risk to health, safety, the environment, or our legal obligations.
We operate in accordance with applicable UK waste management laws and regulations. We will dispose of or recycle waste only at authorised facilities and in line with our legal duties.
Where required by law, we will issue a waste transfer note or other relevant documentation. You agree to provide accurate details for such documentation and to retain your copy as evidence of lawful disposal.
You remain responsible for ensuring that the waste you present is lawful to be removed and does not contain any concealed hazardous materials, prohibited items, or stolen goods.
Our charges are based on factors including the type and volume of waste, weight, labour time, access conditions, and disposal costs. Prices may be quoted as a fixed fee or an estimate, depending on the information available at the time of booking.
Unless otherwise agreed, payment is due on completion of the Services. We may require a deposit or full payment in advance for larger or specialised jobs.
We accept common payment methods such as bank transfer, debit or credit card, and cash, subject to our current payment policies at the time of booking. We do not accept liability for any payment failure caused by your bank or payment provider.
If additional charges arise due to extra waste, extended labour time, or unforeseen access issues, we will explain any revised charges to you before proceeding where reasonably practicable. If you decline the revised charges, we may cancel the Services and charge a reasonable call-out or cancellation fee.
You may cancel or reschedule a booking by contacting us as soon as possible. We request a minimum of 24 hours notice before the scheduled collection time for standard bookings.
Where you provide at least 24 hours notice, any advance payment may be refunded or credited, subject to any non-refundable costs we have already incurred. Where you provide less than 24 hours notice, we reserve the right to charge a cancellation fee to cover our costs, including staff time and travel.
If we arrive at the collection address and are unable to carry out the Services due to your failure to provide access, due to unsafe conditions, or because the waste differs significantly from your description, this may be treated as a late cancellation and a call-out fee may apply.
We may cancel or reschedule the Services due to circumstances beyond our reasonable control, including severe weather, vehicle breakdown, staff illness, or changes in legal requirements. In such cases, we will contact you as soon as reasonably possible to arrange an alternative time. We are not liable for any indirect loss arising from such cancellation or delay.
We aim to provide waste collection services within agreed timeframes. However, all collection times are estimates and are subject to traffic conditions, access issues, and other operational factors.
We will use reasonable care and skill in providing the Services. If you believe the Services have not been carried out as agreed, you must notify us within 48 hours of completion so we can assess the issue and, where appropriate, make reasonable efforts to remedy it.
Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be lawfully limited or excluded.
Subject to the above, our total liability to you arising under or in connection with the Contract, whether in contract, tort, or otherwise, shall be limited to the total fees paid or payable by you for the specific Services giving rise to the claim.
We are not liable for consequential, indirect, or special losses, including loss of profit, loss of business, or loss of opportunity. We are not responsible for loss or damage arising from your failure to comply with these Terms and Conditions, including your failure to clearly separate waste from non-waste items or to provide accurate information about the waste.
While we will take reasonable care when operating at your premises, we are not responsible for minor cosmetic damage to driveways, paths, or surfaces where access is tight or uneven, or where you have requested our vehicles or staff to enter areas not designed for such use.
You agree to indemnify us against any claims, losses, damages, or expenses we incur arising out of:
1. Your breach of these Terms and Conditions.
2. The presence of hazardous or prohibited items concealed within the waste.
3. Any claim that the waste was removed without the consent of the rightful owner.
This indemnity shall not apply to the extent that any claim arises from our negligence or breach of these Terms and Conditions.
We may collect and process personal data relating to you for the purposes of managing bookings, providing the Services, processing payments, and complying with legal obligations. We will handle your personal data in accordance with applicable UK data protection laws.
We will not sell your personal data to third parties. We may share data with service providers who assist us in delivering our Services, such as payment processors, subject to appropriate safeguards.
If you are dissatisfied with any aspect of our Services, please contact us promptly with details of your complaint. We will review your concerns and aim to respond within a reasonable timeframe. Where appropriate, we may offer to revisit the site, rectify issues, or provide a partial refund. Any remedy will be at our discretion and subject to the circumstances of the case.
We may update or amend these Terms and Conditions from time to time to reflect changes in our operations, legal requirements, or industry practice. The version in force at the time of your booking will apply to your Contract. We may provide notice of material changes by updating the information on our website or notifying you directly where appropriate.
We may assign or subcontract our rights and obligations under the Contract, in whole or in part, to suitably qualified third parties, provided this does not materially reduce the standard of the Services. You may not transfer your rights or obligations under the Contract without our prior written consent.
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
The Contract constitutes the entire agreement between you and us in relation to the Services and supersedes all prior discussions, correspondence, or understandings. You acknowledge that you have not relied on any statement or representation not expressly set out in these Terms and Conditions.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
